Methods to Retrieve Deposit?

I initially placed a deposit for an in-transit RR and ended up finding a different one on the lot in the preferred color for a better deal. Now the initial dealership is refusing to return my deposit (I’m in CA and they’re required by law to return the deposit if there was no purchase). I’ve reached out to the salesman, manager, and next general manager…anyone have any advice on this?

EOD I’m so glad I didn’t purchase from this dealership now.

UPDATE: finally got a response after walking my way up the flagpole of the dealership. Should be getting it refunded asap.

Sue in small claims. When you win you can walk into the dealer with the sherif and take anything you want if they don't pay

Funny I was thinking about this same thing because i may be in the same position at some point. Considering abandoning my held-up January build for one at another dealer. I gave my current dealer 5k last May (‘23) but made sure to get it written in email that it was refundable even though they didnt seem happy about me asking that question.

Sorry ur in this position. Agree with whats above, small claims court is prob the best option.

How long ago was the deposit charge made? If within ~90 days, I'd file for a chargeback with your credit card stating the product you purchased wasn't delivered and include the paper trail requesting the refund with the dealer's refusal and maybe the state statute supporting your right to get the deposit returned.

My dealership, when I tried to give them a downpayment, said no downpayment needed. They said when it comes in if you don’t want it we will have no problem selling it. Brandon Ford - Standup dealership and sales team

I had the same situation. Simple. Call your card company. I did this and miraculously the dealer refunded my deposit the next day.

Unfortunate that you are having trouble getting your deposit back. My dealer, BELK FORD, in Oxford, MS ordered my RR last July 10 in my name with no money down and told me that I was not obligated to take the truck. They took good care of me! They also sell for MSRP, having never charged any additional mark-ups for any vehicles.
